FaceMatch Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Exit App Social ("FaceMatch", "we", "us"), and govern your use of the FaceMatch mobile application and website (the "Service"). The Service is operated from Australia.

By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms, do not create an account and do not use the Service. Your only remedy if you are dissatisfied with the Service, these Terms, or any change to either, is to stop using the Service and delete your account.

By using the Service you represent and warrant that all of the above are true, and that they remain true for as long as you hold an account. These are representations by you. We do not verify them and are not responsible for their accuracy.

3. The signup selfie and matching

During signup FaceMatch processes a selfie you provide, once, to facilitate onboarding and to help confirm you meet the 18+ age requirement. How that image and any associated data are handled, retained and deleted is set out in the Privacy Policy.

The order in which profiles are shown to you is determined by our proprietary method. That method is a trade secret. Nothing in these Terms transfers any right, licence or interest in it to you, and you must not attempt to reverse engineer, derive, probe or reconstruct it.

We have zero tolerance for objectionable content and abusive behaviour. Objectionable content and abusive users can be reported in-app; reports are reviewed within 24 hours, and we act on confirmed violations, including removing content and ejecting the offending user.

We may remove content and suspend or terminate accounts that breach these rules, at our sole discretion, with or without notice. We are under no obligation to monitor the Service, and any monitoring or moderation we do choose to perform does not create a duty to detect, prevent or remove any particular content or conduct.

5. Safety, assumption of risk, and release

We do not conduct criminal background checks or identity verification on users. We do not vouch for, endorse, or verify any user, any statement any user makes, or anything any user says about themselves.

You are solely responsible for your interactions with other users, online and offline. You use the Service, and meet anyone you encounter through it, entirely at your own risk.

Take precautions: meet in public, tell someone where you are going, do not share financial information, and never send money to another user. Blocking and reporting tools are available on every profile and in every conversation.

Assumption of risk. You knowingly and voluntarily assume all risks arising from your use of the Service and from any contact or meeting with any person you encounter through it, including risks of emotional distress, financial loss, personal injury and death, whether caused by the conduct of another user, by a third party, or otherwise.

Release. To the maximum extent permitted by law, you release us and our officers, employees, contractors, agents, related bodies corporate, successors and assigns from any and all claims, demands, losses, damages, costs and liabilities of every kind, known and unknown, arising out of or in any way connected with your interactions with other users or with any person you encounter through the Service, or with any dispute between you and another user.

You retain ownership of the content you post. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (for formatting and display), publish and distribute that content for the purpose of operating, promoting within the Service, and improving the Service.

You represent and warrant that you own or have all necessary rights to the content you post, and that it does not infringe anyone's rights.

The licence for a piece of content ends when you delete it or delete your account, except for copies retained in backups until they are overwritten in the ordinary course, and except where the content forms part of a safety report (see the Privacy Policy).

8. Suspension and termination

By you. You may stop using the Service and delete your account at any time, for any reason, in Settings → Delete account. You are not locked in and there is no minimum term.

By us. We may suspend, restrict or terminate your account and your access to the Service at any time, with or without notice, and with or without cause, including where we reasonably consider that:

We do not have to give reasons, and we are not obliged to disclose the content of any report or the substance of any investigation, including where doing so could identify a reporting user or compromise a safety process.

Effect of termination. On termination your profile is removed and you lose access to your matches and messages. Where we terminate your account without cause, or discontinue the Service, we will refund the unused portion of any prepaid subscription period, calculated pro rata (in practice, by directing you to Apple, who administers the charge). Where we terminate for breach of these Terms, no refund is given and you must not create a further account.

To the maximum extent permitted by law, you indemnify us and our officers, employees, contractors, agents and related bodies corporate against all claims, liabilities, losses, damages, penalties, and reasonable legal costs arising out of or in connection with:

These limits apply regardless of the basis of the claim — contract, negligence, statute or otherwise — and apply to the fullest extent permitted by law.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the *Competition and Consumer Act 2010* (Cth)) or under any other law where to do so would be unlawful. Those rights cannot be excluded, and we do not attempt to exclude them.

Where the Australian Consumer Law applies to a supply we make to you, our goods and services come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services supplied again, or to a refund, if the services are not of acceptable quality and the failure does not amount to a major failure.

Every other clause in these Terms — in particular clauses 5, 9, 10 and 11 — applies only to the extent it does not contravene this clause 12, and is to be read down to whatever extent is necessary to make it lawful and enforceable rather than struck out entirely.

If you are in a jurisdiction whose law confers similar non-excludable rights, the same principle applies: those rights are unaffected by these Terms.

If you have a problem, contact us first at https://facematch.live/support. Most issues are resolved there, and doing so is a precondition to any formal proceeding except where urgent injunctive relief is genuinely required. We each agree to attempt in good faith to resolve a dispute within 30 days of it being raised in writing.

These Terms are governed by the laws applicable in Australia. You and we submit to the non-exclusive jurisdiction of the Australian courts, and of the courts competent to hear appeals from them. Nothing in this clause prevents you from bringing a claim in a tribunal or forum that the law entitles you to use, including a small claims tribunal or a complaint to a regulator.

We may update these Terms at any time. Material changes will be notified in the app or by email before they take effect. Continued use after changes take effect constitutes acceptance. If you do not accept a change, your remedy is to stop using the Service and delete your account.
